Wills, Powers of Attorney and Enduring Guardianships
Establishing a Will, Power of Attorney or Enduring Guardianship can be easy with assistance from one of our experienced solicitors.
Wills & Estate Planning
Making a Will is important because it records your wishes as to the people who will inherit your assets, after your death. Without a Will, state laws determine the distribution of your assets and could have consequences which you don’t want or intend.
We have extensive experience in preparing Wills for both large and small estates and can assist with estate planning.
We listen to your needs, wishes and intentions and advise you accordingly to help ensure your intentions for your estate are achieved.
Power of Attorney
A power of attorney is a document which appoints another person or persons to act on your behalf and manage your financial, legal and business affairs should you wish them to act or if you lose capacity to make these decisions for yourself.
Appointing someone as your attorney requires careful thought and consideration and we can advise you in relation to this process and assist by preparing a general, specific or enduring power of attorney according to your needs.
Enduring Guardianship
An enduring guardianship is a document which appoints another person or persons to act on your behalf if you lose capacity to make personal or lifestyle decisions for yourself, for example what medical treatment will you receive if you are ill or where you will live if you can no longer live in your own home.
Like a power of attorney, appointing someone as your enduring guardian requires careful thought and consideration.
We can advise you about the process and work with you to determine how an enduring guardianship can benefit you, including addressing any specific requests or conditions that you may have.
If you have a family member or loved one who needs assistance with their financial or personal affairs but is no longer capable of making a power of attorney or a guardian, we can assist with an application to the Tasmanian Civil and Administrative Tribunal (“TASCAT”) for an administration order to have the appropriate person appointed as their administrator.
